TERMS OF USE (USER AGREEMENT) FOR MOBILE GAME

1. Introduction
1.1. These Terms of Use (the "Terms") govern your use of the mobile game "Elementra: The Sundered World" (the "Game"), developed and operated by LongGammaGames Online Gaming Services L.L.C, with its principal place of business at 104 AL Garhoud Bur Dubai (referred to as "we", "us", "our", or the "Developer").
1.2. By downloading, installing, accessing, or playing the Game, you agree to be bound by these Terms. If you do not agree, you must not use the Game.
1.3. We may update these Terms from time to time. The latest version will be posted within the Game or on our website https://www.longgammagames.com
Your continued use of the Game after changes become effective constitutes your acceptance of the revised Terms.
2. License
2.1. Subject to your compliance with these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to install and use the Game solely for your personal, non‑commercial entertainment purposes.
2.2. You may not:

• copy, modify, reverse engineer, decompile, or disassemble the Game;
• create derivative works based on the Game;
• use cheats, automation software (bots), hacks, mods, or any unauthorised third‑party software designed to modify or interfere with the Game;
• sell, rent, lease, sublicense, distribute, or otherwise transfer your account or access to the Game.

3. User Accounts
3.1. Some features may require you to create an account (e.g., via login, social media, or platform ID such as Steam, Google Play Games, or Apple Game Center). You are responsible for maintaining the confidentiality of your login credentials.
3.2. You must provide accurate and complete information. You are fully responsible for all activities that occur under your account.
3.3. We reserve the right to suspend or terminate any account that violates these Terms, is used for fraudulent or abusive behaviour, or otherwise harms other players or our business.
4. In‑Game Purchases (if applicable)
4.1. The Game may offer virtual items, virtual currency, subscriptions, or other digital content for purchase with real money (each, a "Virtual Item"). All purchases are processed through third‑party app stores (e.g., Steam, Google Play, Apple App Store) and are subject to their terms and refund policies.
4.2. Virtual Items have no real‑world monetary value and cannot be exchanged for real money, goods, or services outside the Game.
4.3. All sales are final and non‑refundable, except as required by applicable law or the relevant app store’s policy.
4.4. We may adjust prices, modify, or discontinue Virtual Items with reasonable notice (e.g., via in‑game news).
5. User Conduct
5.1. You agree not to:

• use the Game to harass, threaten, impersonate, or intimidate other players;
• post or transmit any content that is unlawful, abusive, defamatory, obscene, or otherwise objectionable;
• exploit bugs, glitches, or unintended mechanics to gain an unfair advantage;
• attempt to interfere with the Game’s servers or networks.

6. Intellectual Property
6.1. All rights, title, and interest in and to the Game (including its code, graphics, music, characters, logos, and all other elements) are owned by the Developer or its licensors and are protected by international copyright, trademark, and other intellectual property laws.
6.2. These Terms do not grant you any ownership rights in the Game or any intellectual property of the Developer.
7. Privacy
7.1. Our collection and use of your personal data is described in our Privacy Policy, available at https://www.longgammagames.com/privacypolicy
By using the Game, you consent to the data practices set forth in the Privacy Policy.
7.2. The Game may include third‑party services (e.g., analytics, advertising). Those services have their own privacy policies, and we encourage you to review them.
8. Age Requirements
8.1. You must be at least 16 age or required by your country years old to use the Game. If you are under the age of majority in your jurisdiction, your parent or legal guardian must review and agree to these Terms on your behalf.

9. Disclaimer of Warranties
9.1. THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
9.2. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR‑FREE, SECURE, OR FREE OF BUGS OR VIRUSES, OR THAT ANY DEFECTS WILL BE CORRECTED.
10. Limitation of Liability
10.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GAME PROGRESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE GAME.
10.2. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US (IF ANY) IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS LESS.
11. Indemnification
11.1. You agree to indemnify, defend, and hold harmless the Developer and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of your violation of these Terms or your misuse of the Game.
12. Termination
12.1. These Terms are effective until terminated. You may terminate them by uninstalling the Game and ceasing all use.
12.2. We may suspend or terminate your access to the Game at any time, without notice, if you breach these Terms or if required by law.
12.3. Upon termination, all rights granted to you under these Terms will cease, and you must delete the Game from your devices.
13. Governing Law and Dispute Resolution
13.1. These Terms shall be governed by and construed in accordance with the laws of [your country/state], without regard to its conflict of laws principles.
13.2. Any dispute arising from or relating to these Terms or the Game shall first be attempted to be resolved through informal negotiation within thirty (30) days. If the dispute cannot be resolved, it shall be submitted to binding arbitration or the competent courts of Dubai, UAE at the Developer’s discretion.
13.3. If you are a consumer residing in a jurisdiction that requires a different dispute resolution mechanism, that mandatory law will prevail.
14. Miscellaneous
14.1. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
14.2. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
14.3. We may assign these Terms (in whole or in part) to a successor entity. You may not assign your rights or obligations under these Terms without our prior written consent.
